fa قرآن و تفاوت‌های‌ فرهنگ پوشش کنیزان با زنان آزاد؛ از جاهلیت تا صدر اسلام تخصصي Special پژوهشي Research <strong><span style="color:black;"><span style="font-family:B Mitra;"><span style="font-size:14.0pt;">چکیده</span></span></span></strong><br> <span style="color:black;"><span style="font-family:B Mitra;"><span style="font-size:14.0pt;">در فقه فریقین یک وفاق نسبی وجود دارد که کنیزان از حکم وجوب پوشش سر و صورت، مستثنا شده‌اند. در قرآن کریم به مستثنا شدن کنیزان تصریح نشده است. پس از رحلت پیامبر اکرم صلی الله علیه و آله مرجعیت علمی اهل بیت علیهم السلام به عنوان معلمان و مفسران قرآن، نادیده انگاشته شد. از طرف دیگر، صحابه نیز دانش و تسلّط کافی برای گره‌گشایی از معانی قرآن کریم نداشتند. این عوامل موجب شد جامعه پس از پیامبر صلی الله علیه و آله تعداد قابل توجهی از آیات قرآن کریم را با سوء برداشت یا اجتهادات مصلحت‌محور نقض کند. نقض آیات قرآن کریم توسط جامعه پس از پیامبر صلی الله علیه و آله این احتمال را به وجود می‌آورد که &laquo;مستثنا شدن کنیزان از حکم قرآنی حجاب شرعی&raquo; نیز سنت پیامبر اکرم صلی الله علیه و آله نباشد؛ بلکه از قبیل همین موارد باشد. این مقاله برای بررسی همین احتمال تدوین شده است. هرچند مسئله پوشش کنیزان، امروزه مسئله مورد ابتلایی نیست؛ اما درک مسائلی مانند مقاصد شارع، علل تشریع احکام، نظام جنسیتی مورد نظر اسلام به تحلیلی که از پوشش آنان داریم وابستگی دارد.</span></span></span><span dir="LTR"><span style="color:black;"><span style="font-size:14.0pt;"></span></span></span><br> <strong><span style="color:black;"><span style="font-family:B Mitra;"><span style="font-size:14.0pt;">واژگان کلیدی:</span></span></span></strong> <span style="color:black;"><span style="font-family:B Mitra;"><span style="font-size:14.0pt;">پوشش، کنیزان، حجاب، فقه، خلافت، جاهلیت، پیامبر.</span></span></span> <span dir="LTR"></span> <strong>Abstract</strong><br> In the jurisprudence of the two sects, there is a relative agreement that the maids are exempted from the obligation to cover their heads and faces. The Holy Quran does not specify the exception of maids. After the death of the Holy Prophet (sawa) the scientific authority of the Ahl al-Bayt (as) as teachers and interpreters of the Quran was ignored. On the other hand, the companions did not have enough knowledge and mastery to untie the meanings of the Holy Quran. These factors caused the society after the Prophet (sawa) to violate a significant number of verses of the Holy Quran by misunderstanding or expediency-based ijtihads. Violation of the verses of the Holy Quran by the society after the Prophet (sawa) raises the possibility that &quot;the exemption of maids from the Quranic rule of the religious hijab&quot; is not the tradition of the Holy Prophet (sawa); but be like these cases. This article is compiled to investigate this possibility.
